The ASK-Opinions panel is part of ASK-Opinions B.V., registered with the Dutch Chamber of Commerce under number 81618131.
Below are the step-by-step rights and obligations of being a member of ASK-Opinions. By registering with ASK-Opinions, you agree to the following points:
Article 1: Applicability; Agreement
1.1 These Terms and Conditions apply to your use of ASK-Opinions' services, including but not limited to (1) membership in one of ASK-Opinions' consumer panels or sub-panels, (2) use of and/or access to the ASK-Opinions.com website, (3) participation in a survey, research, poll, or other similar activity offered, provided, hosted, or managed by or through ASK-Opinions, (4) the content we provide, and (5) eligibility for and/or redemption of rewards, incentives, discounts, and prizes offered for certain actions and activities, including but not limited to the successful completion of surveys. ASK-Opinions is a consumer panel that you can join for free. As a participant in panel activities, you have no obligations towards the consumer panel, except for the obligations mentioned in these terms. ASK-Opinions reserves the right to refuse, limit, prohibit, and/or reject your access to, use of, and/or participation in the services at any time and for any reason.
1.2 Dutch law applies to the agreement.
Article 2: When can you participate?
2.1 Membership of ASK-Opinions is generally available to individuals who meet the membership requirements, including but not limited to minimum age (16 years or older) and geographical location (residing in the UK). Membership requirements may vary by panel or sub-panel of ASK-Opinions. We only allow one member per unique email address. ASK-Opinions may refuse to offer its services to anyone at any time, for any reason, and without explanation.
2.2 If multiple accounts are used within one household, they are strictly monitored to ensure separate management. Additionally, there should be no similarities between these accounts. If we find that these conditions are violated, we will block the accounts.
Article 3: Registration / Becoming a Member
3.1 When registering, your information must be filled out truthfully.
3.2 Each person may register with ASK-Opinions only once. Panel membership is specific to the person who registers for membership with ASK-Opinions. You acknowledge that you access, use, and/or participate in the services as an independent contractor, and no relationship of agency, partnership, joint venture, employer-employee, or franchisor-franchisee is implied or created as a result of this agreement.
3.3 If your personal details change, they must be updated as soon as possible (e.g., if you have a new email address or home address).
3.4 All requested data must be filled in.
3.5 As a member, you are responsible for the security of your username and password, and you are responsible and liable for the authorized or unauthorized use of your membership account. ASK-Opinions strongly advises against using a social security number, financial account number, or any other identification or account number as your username or password.
3.6 You should only register if you are genuinely interested in being a member of ASK-Opinions. If it is found that you have provided incorrect or false registration information, your account will be terminated, and you will lose all earnings.
3.7 Make sure your email address is always reachable. If we receive a notification that your email address is unreachable (bounce), no further emails will be sent to you. If you are not receiving emails from ASK-Opinions because your email address was or is unreachable, please contact ask@ask-opinions.com.
Article 4: Participation in Research & Incentives
4.1 By registering with ASK-Opinions, you consent to receive emails from ASK-Opinions and our partners.
4.2 Emails are often targeted at specific demographics. Based on your profile information, you may receive fewer or more emails than other members.
4.3 The same email address cannot be provided twice.
4.4 The reward stamps mentioned in the invitations from ASK-Opinions are the compensation you receive for fully completing the survey. If you do not belong to the target group of the survey or if there are already enough participants, the reward stamps will not be granted.
4.5 For filling out surveys, you receive a financial reward. To do this, you need to enter your name and IBAN number in your personal ASK-Opinions account.
Article 5: Winning Prizes
5.1 Wherever possible, we try to organize fun actions/promotions for our members. These may include: raffling a prize among members who participate in surveys, or other similar actions organized by ASK-Opinions (possibly provided by a client/partner), or discounts on products (possibly after completing a survey). No rights can be derived from the organization of discount or prize promotions; for example, as a supplement or substitute for regular compensation for completing surveys, or as a bonus, and the frequency with which these are organized.
5.2 ASK-Opinions cannot be held liable for actions or promotional conditions sent to you on behalf of our direct partners. When you receive a communication on behalf of one of our partners, we always indicate who the sender is. We advise you to carefully review the general terms and conditions of the respective partner.
5.3 If you win a prize through one of ASK-Opinions' services, the following conditions apply: prizes will only be awarded if you meet the conditions, and prizes will be awarded/sent to the address/account you provided at registration. Ensure this information is always up to date. Participation in the services offered by ASK-Opinions is entirely at your own risk.
5.4 ASK-Opinions reserves the right not to organize discount or prize promotions.
5.5 Except as prohibited by applicable law, you acknowledge and agree that in no event shall ASK-Opinions be liable for any indirect, incidental, special, consequential, or punitive damages for any reason or cause whatsoever, whether or not ASK-Opinions was aware of the possibility of such damages. Any claim or dispute arising out of or related to your use of ASK-Opinions’ services and/or these terms must be filed within one year after such claim or dispute arises.
Article 6: Payment of balance
6.1 In the context of using the services, you have the opportunity to receive rewards, incentives, and entries into prize draws. Information, official rules, and general terms and conditions for rewards, incentives, and prize draws may be available on the panel's website, at the beginning or end of a survey, in survey invitations, and/or on the websites of ASK-Opinions and/or its direct partners. Incentives and/or prizes may be described in newsletters or other forms of communication distributed or published by ASK-Opinions and/or its direct partners. Rewards, incentives, and prizes are non-transferable.
6.2 We issue full savings cards of 25 stamps, and for each full savings card of 25 stamps, you receive 2 euros.
6.3 Payments can be made via bank account and are subject to SEPA conditions. To request a payment, you must provide your name and an IBAN number in your personal ASK-Opinions account.
6.4 Payments are only made in multiples of 25 stamps. The remaining balance stays in your account, allowing you to save up for the next payout.
6.5 A bank account may only be used for one ASK-Opinions account. If it is used for multiple accounts, ASK-Opinions reserves the right to seize all accounts of the participant in question.
6.6 Your payment request will be processed within 7 working days. No rights can be derived from ASK-Opinions' payment term.
6.7 The (electronic) accounting of ASK-Opinions serves as proof of payment, unless proven otherwise by you in writing as a panel member.
6.8 Regarding "income from participation in online panels", please contact the Tax Information Line. ASK-Opinions holds the member responsible for reporting the amount earned through ASK-Opinions, if required. ASK-Opinions is not responsible for any claims or fines you may receive for failing to declare or incorrectly reporting your earnings.
Article 7: Privacy and personal data
7.1 In order to provide its services, ASK-Opinions must process your personal data. ASK-Opinions records this personal data in a database.
7.2 ASK-Opinions ensures that the processing of personal data complies with the applicable (privacy) laws, including regulations in the field of e-marketing, as laid down in the Telecommunications Act. Your data will never be traceable to you as an individual and is used only for internal reporting by ASK-Opinions and its partners. Your answers and data are only analyzed in combination with other data and are never traceable to you as an individual, unless you explicitly consent. The Privacy Policy on ASK-Opinions.nl applies to the use of this data by ASK-Opinions.
Article 8: Services
8.1 ASK-Opinions' services, including but not limited to (1) membership of one of the consumer panels or subpanels of ASK-Opinions, (2) the use of and/or access to the website ASK-Opinions.nl, (3) participation in a survey, research, poll, or other similar actions, offered, provided, hosted, or managed by or via ASK-Opinions, (4) the content we provide, and (5) eligibility for and/or redeeming rewards, incentives, discounts, and prizes offered for certain actions and activities, including but not limited to successfully completing surveys, are created with the utmost care, but with the exclusion of any guarantees, promises, or warranties of any kind. In particular, ASK-Opinions does not guarantee that:
services operate uninterrupted, are free from viruses, trojans, and other errors and/or defects, nor that defects can (timely) be corrected;
mailings and the information offered are appropriate, current, reliable, and lawful;
there are no inaccuracies or incomplete information in the rewards system;
third parties will not misuse the services.
8.2 The services of ASK-Opinions are for personal, non-commercial use. You can only use the services when and if they are available. ASK-Opinions reserves the right to modify, change or terminate access to its services or part of them at any time and without notice, for any reason or without giving a reason. ASK-Opinions offers its users the opportunity to participate in surveys and to take part in the services of ASK-Opinions' direct partners, namely competitions, discount codes, and similar actions. Participation in surveys is entirely voluntary. ASK-Opinions makes every reasonable effort to secure the service against loss and/or any form of unlawful use of your personal data or account.
8.3 ASK-Opinions makes every reasonable effort to secure the service against loss and/or any form of unlawful use of your personal data or account. ASK-Opinions implements appropriate technical and organizational measures for this, taking into account the state of the art.
ASK-Opinions is entitled to temporarily suspend or restrict its service if necessary for maintenance or adjustments, without any right to compensation.
Article 9: Website Content
9.1 Despite the constant care and attention ASK-Opinions devotes to the composition of its website and the data contained therein, ASK-Opinions cannot guarantee the completeness, accuracy, or continuous timeliness of the data.
9.2 ASK-Opinions can in no way be held responsible for the content of its website and is not liable for any direct or indirect damage that may result from the expressions concerned.
9.3 No rights can be derived from the information on the ASK-Opinions.nl website or from the extent to which this information is suitable for the purpose for which you consult it. All information, products, and services are offered as they are and without any (implied) guarantee or warranty regarding their quality, suitability for a particular purpose, or otherwise.
Article 10: User Content
10.1 You are solely liable and responsible for all content, material, information, and comments that you use, upload, post, or submit in relation to the services ("user content"). For example, when you post a review about us or a prize you have won by using our services. You are solely responsible for all approvals, consents, and/or licenses from third parties that are required for the user content. If you submit user content, it may be made publicly available and shared with third parties, including but not limited to, ASK-Opinions’ customers, customers of ASK-Opinions' customers, and external service providers. User content may include audio, video, images, or likeness of the person submitting the user content and must not contain content that is copyrighted or trademarked by third parties. User content must not include audio, video, images, or likeness of anyone other than the user. You will not receive compensation for user content.
10.2 By using, uploading, posting, or submitting user content, you grant ASK-Opinions a perpetual, irrevocable, unrestricted, transferable, worldwide, royalty-free right and license to edit, copy, transmit, publish, display, create derivative works from, reproduce, modify, distribute, or otherwise use, alter, or disseminate your user content in any way, without any form of compensation or notice.
10.3 You are responsible for the user content, and ASK-Opinions cannot and will not review all user content, nor is ASK-Opinions responsible for user content. ASK-Opinions reserves the right to remove, move, or edit user content that, in ASK-Opinions' judgment: (i) violates these Terms, (ii) infringes copyright or trademark laws, or (iii) is offensive, defamatory, obscene, or otherwise unacceptable.
Article 11: General
11.1 If you are not actively participating in the panel for six months (not logging in, not reading emails, not signing up people, etc.), your membership will be automatically terminated without prior notice. The points accrued on your account up to that point will be canceled, and your account will be destroyed.
11.2 ASK-Opinions reserves the right to modify these terms and conditions at any time and will inform its users as best as possible. The current version of the terms and conditions can be found on the ASK-Opinions.com website. Upon modification of the terms and conditions, the old terms and conditions will cease to apply. Any disputes can only be submitted to the competent court in the Netherlands.
11.3 ASK-Opinions reserves the right to modify its services at any time, for example, by changing (monetary) prizes and awarding seals.
11.4 ASK-Opinions reserves the right to transfer subpanels to or merge them with the main panel of ASK-Opinions.
11.5 If you disagree with any changes to the terms and conditions, you may unsubscribe from ASK-Opinions at any time. By remaining a member, you automatically agree to any changes to the terms.
11.6 In the event of unsatisfactory results, ASK-Opinions reserves the right to discontinue its services. No rights can be derived from the redemption of remaining seals.
11.7 As a user of ASK-Opinions' services, you are responsible for reporting any income earned through ASK-Opinions to the tax authorities.
11.8 You agree to indemnify, defend, and hold harmless ASK-Opinions, its consumer panels and (sub)panels, the parent company, subsidiaries, and affiliated companies and their respective members, managers, shareholders, directors, employees, and representatives from and against any claims, liabilities, losses, judgments, awards, penalties, and costs and/or expenses of any kind, including, without limitation, reasonable attorneys' fees and costs arising from or caused, directly or indirectly, by: (i) your breach or violation of these Terms and Conditions; and/or (ii) your use of and/or participation in and/or access to the services.
Article 12: Termination of Membership
12.1 You can unsubscribe from using the services of ASK-Opinions at any time by logging into ASK-Opinions.com and opting out via the settings of your personal account. You will then receive an email confirming your unsubscription. When you confirm this, you will be unsubscribed from ASK-Opinions.
12.2 Upon termination, no seals can be credited or debited to your account, and all seals credited to your account will be canceled.
12.3 In the event of fraud, providing incomplete or incorrect information, or if you act in violation of these terms, abuse the rights you have as a user of the services of ASK-Opinions, or in any other way cause harm to ASK-Opinions and its services, ASK-Opinions is entitled, without prejudice to all our other rights, to terminate your registration immediately and cancel your account and the seals credited to it.
Article 13: Unauthorized Use
You agree not to engage in: (i) the use of spiders, robots, or other automated data mining techniques to catalog, download, store, or reproduce or distribute data or content related to the services, or to manipulate the results of a survey, sweepstakes, or contest; (ii) taking any action to interfere with a website(s) or an individual's use of a website, including but not limited to overloading a website through "flooding," "mail bombing," or "crashing"; (iii) sending or transmitting viruses, corrupted data, or other harmful, disruptive, or destructive codes, files, or information, including but not limited to spyware; (iv) collecting personally identifiable information from or about another user of the services; (v) sending unsolicited emails, including but not limited to promotions and/or advertising for products or services; (vi) opening, using, or maintaining more than one (1) account membership in a panel; (vii) falsifying or concealing your true identity; (viii) incorporating any portion(s) of a website into another website or altering the appearance of a website; (ix) linking another website to a page of, on, or in a website or the Services without the prior written consent of ASK-Opinions; (x) posting or transmitting threatening, defamatory, obscene, pornographic, indecent, offensive, or incendiary material or content or material or content that would otherwise violate applicable law (as defined herein); (xi) engaging in fraudulent activities, including but not limited to completing surveys at an accelerated rate, completing the same survey multiple times, concealing or falsifying your identity, providing false information during the registration process, submitting false or misleading survey data, fraudulently redeeming or attempting to redeem rewards, prizes, and/or incentives and tampering with surveys; (xii) applying reverse engineering to aspects of the services or performing any act that may reveal or disclose the source code or circumvent measures or controls used to restrict or prohibit access to a website, content, or code except as expressly permitted by applicable law; (xiii) participating in criminal or illegal act(s); (xiv) using restricted Content (as defined herein) that constitutes a violation of these Terms; or (xv) encouraging and/or advising any person, including but not limited to an employee of ASK-Opinions, to engage in any action prohibited by these Terms. You acknowledge and agree that ASK-Opinions will cooperate fully with all legal requests for disclosure (e.g., court orders or subpoenas).
Article 14: Conclusion
14.1 In the event of fraud and/or transfer of the aforementioned rules, your savings card will be withdrawn and your account deleted. If necessary, the data will be passed on to the person concerned. Your access to the panel will also be blocked and you will not be able to participate again in the future.
14.2 As a member, you cannot claim any errors that may have been made by ASK-Opinions. Both parties benefit from this being reported to ASK-Opinions by you as a member. This will still be reasonably resolved by ASK-Opinions.
14.3 Despite all the care that ASK-Opinions takes regarding the panel and associated services, it may happen that you are not satisfied. You can submit your complaint to us via the website ask-opinions.com.
14.4 No unwanted emails may be sent to other people, or in any other way where someone learns about the panel, while you do not know this person, or the person has not asked for it. If this happens, your membership will be terminated.
14.5 ASK-Opinions cannot accept liability for unauthorized use of and/or participation in the panel. If you suspect or could reasonably suspect that there has been an incorrect credit or debit of your balance, you are required to report this to ASK-Opinions. If you redeem rewards obtained inappropriately, you are obliged to pay ASK-Opinions compensation equal to the value of the money disbursed by ASK-Opinions.
Article 15: Disclaimer The services, including all information, surveys, content, materials, comments, and services made available on or through the services, are provided "as is." ASK-Opinions makes no representations or warranties of any kind regarding the information, content, materials, comments, surveys, products, or services made available on or through the services, including but not limited to user content. Furthermore, ASK-Opinions disclaims all warranties, both express and implied, including but not limited to implied warranties of non-infringement, merchantability, and fitness for a particular purpose. ASK-Opinions does not warrant that the resources, technologies, or features included in the services or any content, materials, comments, information, and/or services therein will not be interrupted or free from errors, that defects will be corrected, or that the systems or servers that support the services are free from viruses or other harmful files. ASK-Opinions does not provide access to or connection with the internet and is not and will not be responsible for the actions or omissions of third parties that impede, limit, or prevent access to or connection with or use of the services.
General terms and conditions for price draws by ASK-Opinions
The contest is organized by ASK-Opinions BV.
Participation in the action
Participation in the actions is free of charge.
Participation in the actions is only possible for persons aged 18 years or older.
Employees of ASK-Opinions are excluded from participating in the actions.
The duration of the actions and the time of announcing the winner(s) will always be stated.
ASK-Opinions is entitled to change the terms and conditions of the actions at any time or to terminate the actions without giving any reason.
Personal data
Personal data of participants will not be disclosed to third parties without consultation, unless permission has been granted to receive a newsletter from an external party.
Personal data of participants may be used internally for signing up for the ASK-Opinions newsletter, provided permission has been granted in the action.
Dutch law applies to all actions.
Winner
The winner of an action is chosen by a random drawing in an impartial manner.
The winner of an action will be personally notified via email. If an email address has been provided, the winner will be notified via email.
If the winner does not come forward within a week of the announcement, a new winner will be selected.
ASK-Opinions has the right to exclude individuals from participation if there is a suspicion of unlawful participation or fraud.
It is not possible to exchange the won product for another product or cash.
